These Terms of Service ("Terms") constitute a binding agreement between you and Pabble ("we", "our", or "us"), the operator of the platform available at pabble.app. By creating an account or using any part of the Service, you confirm that you have read these Terms and agree to be bound by them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

1. The Service

Pabble provides two integrated capabilities:

  • Form Builder: a visual tool to design, publish, and manage online forms with custom fields, conditional logic, and respondent-facing branding.
  • Flow Builder: an automation layer that lets you configure post-submission workflows: sending emails, firing webhooks, routing data to connected applications, applying conditional branches, and executing follow-up sequences based on what respondents submit.

We may introduce new features, modify existing functionality, or retire capabilities with reasonable notice. We are not obligated to maintain any specific feature indefinitely.

2. Account Registration

To use the Service, you must:

  • Be at least 18 years of age.
  • Provide accurate, current, and complete registration details and update them if they change.
  • Keep your login credentials confidential. You are solely responsible for all activity that occurs under your account.
  • Notify us immediately at harshkanjiya001@gmail.com if you believe your account has been compromised.

Sharing account credentials with multiple individuals outside of an authorised team workspace is prohibited. Each person who regularly uses the Service must have their own seat.

3. Acceptable Use

You may use the Service for any lawful purpose that is consistent with its intended function. The following are expressly prohibited:

  • Collecting personal data from Respondents without a clear notice of purpose or required consent.
  • Designing forms to deceive, mislead, or phish individuals into submitting sensitive information under false pretences.
  • Using flow automations to transmit unsolicited bulk communications to individuals who have not opted in.
  • Attempting to probe, scan, or test the vulnerability of the platform or circumvent its security controls.
  • Processing health records, payment card data, or other regulated categories of sensitive information without a separate written data processing agreement with us.
  • Reselling, sublicensing, or otherwise commercialising access to the Service without our written consent.
  • Violating any applicable local, national, or international law or regulation.

4. User Content

You retain full ownership of the forms you build, the automations you configure, and the Response Data collected through your forms ("User Content"). By using the Service, you grant Pabble a limited, non-exclusive, royalty-free licence to host, process, transmit, and display your User Content solely to the extent necessary to deliver the Service to you. We do not claim any further rights over your content.

You represent and warrant that your User Content does not infringe the intellectual property, privacy, or other rights of any third party, and that you have all permissions required to collect the data your forms request.

5. Flow Automations and Third-Party Actions

The Flow Builder lets you trigger external services, sending email notifications, posting to webhooks, updating connected applications, based on form submissions. You acknowledge and agree that:

  • You are solely responsible for the content of any automated messages dispatched to Respondents or third-party endpoints.
  • You must ensure that each third-party service you connect complies with applicable data protection and communication laws in the jurisdictions where your Respondents are located.
  • Pabble is not liable for errors, downtime, or data loss resulting from third-party services connected to your flows.

6. Subscriptions, Pricing, and Billing

Paid plans are billed in advance, on either a monthly or annual cycle as selected at checkout. By subscribing, you authorise us (via our payment processor) to charge your payment method on each renewal date.

  • Price changes: we will provide at least 30 days' notice of any price increase. Your continued use after the effective date constitutes acceptance of the new price.
  • Payment failure: if a charge cannot be processed, we will attempt to notify you and retry. Accounts with outstanding balances beyond a reasonable cure period may be suspended.
  • Plan changes: upgrades take effect immediately; the prorated difference is billed at once. Downgrades take effect at the start of the next billing cycle.

7. Refunds

New subscriptions are eligible for a full refund within 7 days of the initial charge, provided you have not exceeded the free-plan usage limits during that period. Renewal charges are non-refundable. To request a refund within the eligible window, contact harshkanjiya001@gmail.com with your account email and billing reference.

8. Intellectual Property

The Pabble name, logo, platform design, underlying software, and all documentation are owned by us and protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited licence to use the Service during an active subscription.

Any feedback, suggestions, or ideas you share with us about the Service may be used by us without compensation or attribution to you.

9. Third-Party Integrations

The Service may offer native integrations with third-party tools such as CRM systems, email marketing platforms, payment gateways, and storage providers. These integrations are provided for convenience. We do not control third-party services and are not responsible for their uptime, accuracy, or compliance. Your use of any third-party service is subject to that service's own terms and policies.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Pabble disclaims all warranties, express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will meet your specific requirements or that any defects will be corrected within a particular timeframe.

11. Limitation of Liability

To the maximum extent permitted by law, Pabble's aggregate liability to you for any claim arising out of or relating to your use of the Service, regardless of the cause of action, shall not exceed the total fees paid by you in the twelve months immediately preceding the event giving rise to the claim.

In no event shall we be liable for indirect, incidental, consequential, punitive, or special damages, including loss of data, loss of profits, or loss of business, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pabble and its officers, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) User Content you create or Response Data you collect; or (c) your infringement of any third party's rights.

13. Termination

You may close your account at any time from the account settings. We may suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms or applicable law.

Upon termination: access to the Service ceases immediately. Your data will be retained for 30 days to allow you to export it, after which it will be permanently deleted. Provisions that by their nature should survive, including intellectual property rights, limitation of liability, and indemnification, will continue to apply after termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall first be submitted for resolution through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts in India.

15. Changes to These Terms

We reserve the right to amend these Terms at any time. For material changes, we will provide at least 14 days' notice via email and an in-app notification. The updated Terms will display a revised date at the top of this page. Your continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms.
